Man charged with malice murder following Jan. 27 death

A Carlton man has been charged with malice murder following the death of an Elberton man Jan. 27, according to a press release from the Georgia Bureau of Investigation (GBI) and the Elbert County Sheriff's Office (ECSO). 

James Brandon Allen, 37, of a Carlton address, was charged by the GBI with malice murder, aggravated battery, concealing the death of another person and false statements in connection with the Jan. 27 death of Roy McCannon, 66, of a Lincolnton Highway address. 

Allen was previously arrested by the ECSO Jan. 28 and charged with battery. According to the jail log records for Allen's arrest, he "works at McCannon Granite." 

McCannon was "found in a vehicle" at a Hester Road address after a call came in around 10:20 p.m. Jan. 27, according to the GBI press release, dated Feb. 2 and sent out Feb. 3.   

"Deputies discovered a deceased man with obvious head injuries which were from an apparent physical assault," according to the GBI press release.

Allen has been booked in the Elbert County Detention Center since his arrest Jan. 28, according to jail records.

From the Feb. 1 edition of The Elberton Star: A death over the weekend has been labeled a murder, according to an incident report from the Elbert County Sheriff’s Office (ECSO), and is being investigated with help from the Georgia Bureau of Investigation (GBI)

Roy McCannon, 66, of a Lincolnton Highway address, was pronounced deceased “as a result of violence” by Elbert County Coroner Chuck Almond at 11:35 p.m. Jan. 27.

According to an incident report from the ECSO, the incident took place at a Hester Road address around 10 p.m. Jan. 27.

“Elbert County E911 received a call at 10:21 p.m. on Jan. 27 for an unresponsive person at a Hester Road address,” Almond said in a release on the Elbert County Coroner’s Office Facebook page Jan. 28. “Upon arrival of authorities, the ECSO requested assistance from the GBI in further investigating this incident.”

Almond said Monday that first responders who arrived on the scene determined that McCannon was deceased and that he had “visible injuries” that led them to believe there was “foul play” involved.

McCannon’s body was sent to the Georgia Medical Examiner’s office for an autopsy Monday, Almond said.

Chief Deputy Darren Scarborough said Tuesday that the incident is still under investigation.
